2. SharkPay’s Role

SharkPay is an independent merchant-services broker, sales agent, and payment-solutions consultant.

We help businesses:

  • Select point-of-sale equipment and software;
  • Request pricing or savings analyses;
  • Submit merchant account applications;

POS products and software may also be provided by independent third-party manufacturers, distributors, licensors, or technology companies.

When you request or apply for a service through SharkPay, we may transmit your information to one or more third-party providers so they can evaluate your application, provide pricing, perform underwriting, establish an account, supply equipment, or provide the requested service.

Some merchant application information may qualify as sensitive personal information under state law.

SharkPay may collect application information directly and forward it to a third-party provider. In other cases, you may enter the information directly into a processor’s, bank’s, underwriter’s, or technology provider’s secure application system.

Once information has been submitted to an independent provider, that provider’s collection, use, retention, and disclosure of the information is governed by its own privacy notice and applicable agreements.

You may provide current or previous merchant-processing statements so that SharkPay can:

Please remove or obscure information that is not required for the requested review. Do not send full card numbers, account passwords, PINs, security codes, or unrelated personal information.

SharkPay does not intend to collect or store full consumer payment-card numbers through its public website.

When sensitive information is needed for a merchant application, SharkPay or the applicable third-party provider may provide a secure submission method.

A link, referral, introduction, recommendation, or application assistance does not make SharkPay responsible for a third party’s privacy, security, pricing, underwriting, or service practices.

8. Payment-Card and Transaction Information

SharkPay does not itself authorize, clear, settle, or fund payment-card transactions.

Payment-card transactions are handled by the applicable:

  • POS platform;
  • Payment gateway;
  • Payment processor;
  • Acquiring bank;
  • Card network;
  • Financial institution.

SharkPay may receive limited merchant-level information needed to provide brokerage, account-management, installation, or support assistance. This may include processing volume, fees, account status, masked identifiers, chargebacks, refunds, or technical information.

We do not intend to receive or store full cardholder account numbers, card security codes, or PINs.

Merchants are independently responsible for:

SharkPay uses sensitive personal information primarily to provide requested merchant-services assistance, facilitate applications, prevent fraud, maintain security, and comply with law.

We do not intend to use sensitive personal information to infer characteristics about individuals.

Shine the Light

California Civil Code Section 1798.83 may permit California residents to request information concerning certain disclosures of personal information to third parties for their direct-marketing purposes.

26. Nevada Residents

Nevada residents may submit a verified request to opt out of a qualifying sale of covered information under Nevada law.

SharkPay does not currently sell covered information for monetary consideration as that term is defined under Nevada law.

27. Children’s Privacy

The Services are intended for businesses and adults acting in a commercial or professional capacity. They are not directed to children under 13.

We do not knowingly collect personal information from children under 13 through the website. If you believe a child has provided personal information to SharkPay, contact info@getsharkpay.com so we can review and delete the information when appropriate.

28. Business-to-Business Information

Many individuals interact with SharkPay as an owner, employee, contractor, or representative of a business.

We may use business contact information to communicate about products and services that may be relevant to that person’s organization. Privacy rights concerning business-to-business information vary by jurisdiction.

29. Third-Party Websites and Services

The website may contain links to third-party websites, application portals, processor sites, POS platforms, social media services, or other resources.

SharkPay does not control those third parties. This Privacy Policy does not govern information collected after you leave our website or submit information directly to another organization.

Review the applicable third party’s privacy policy before providing personal information.

30. Social Media

When you interact with SharkPay through a social media platform, the platform may collect information under its own privacy policy.

Information you post publicly may be visible to other users. Avoid posting merchant credentials, bank information, application documents, payment-card information, or other confidential information through public comments or posts.

31. International Visitors

SharkPay is based in the United States and primarily offers services to businesses in the United States.

If you access the website from another country, your information may be transferred to and processed in the United States. Privacy laws in the United States may differ from those in your jurisdiction.

Do not submit a merchant application unless the proposed provider accepts applications from your location.

32. Changes to This Privacy Policy

We may update this Privacy Policy to reflect:

  • Changes to our Services;
  • Changes to our technology;
  • New providers or business practices;
  • Legal or regulatory developments;
  • Security or operational requirements.

The updated version will be posted on getsharkpay.com with a revised “Last Updated” date.
